Hit by a Golf Ball? Legal Expert Explains Who’s Responsible

Have you ever been driving down the street when—out of nowhere—a golf ball smashes into your windshield? It happens more often than you think. One of our viewers, Brian Turner, reached out to The Roggin Report asking what legal options are available if a stray golf ball causes damage or injury.

For answers, legal consultant Walter Clark weighed in, confirming that the responsibility ultimately falls on the golf course or country club. “Basic negligence,” Clark explained. “You are responsible for things that get away from you—whether it’s a dangerous animal, flood water, or even radiation, like in the Silkwood case. The golf facility has control over its property and should take reasonable precautions.”

One common concern is whether the victim must identify the golfer who hit the ball. Clark dismissed this as unnecessary. “That’s one of the funniest things I’ve ever heard,” he said. “There’s no need to track down the bad golfer.”

So what should you do if your car is hit by a golf ball while driving past a course? Clark recommends having comprehensive auto insurance, which covers incidents like falling trees, fire, theft, and yes—golf ball damage. If insurance isn’t an option, victims can file a claim in small claims court for up to $12,500.

“These claims are usually small, which is why you don’t see class-action lawsuits over golf ball damage,” Clark added. “But you have the right to take the course to court and seek compensation.”

While errant golf balls may be an unfortunate reality near golf courses, victims have options to ensure they’re not left footing the bill.
